IPR Litigation & Enforcement

Oppositions, infringement suits and damages recovery.

A registration is only as good as its enforcement. Our legal team handles the full contentious side — from a cease-and-desist notice through to suits before the District Court and above.

Oppositions, rectifications, cease-and-desist notices, infringement and passing-off suits and recovery of damages — led by our in-house advocates.

What we handle

  • Trademark oppositions and counter-statements
  • Rectification and cancellation petitions
  • Cease-and-desist and legal notices
  • Infringement and passing-off suits, injunctions and damages
  • Design piracy actions under Section 22 of the Designs Act
  • Copyright infringement complaints and criminal remedies

Why registration strengthens your case

Only the owners of registered trademarks can take action or sue for damages. Trademark protection is not enforceable for unregistered marks. Where a logo is registered both as a trademark and as an artistic work, the infringer can be sued on two counts.
