What the professional fee covers
Professional fees across the Indian market range from about ₹1,500 to ₹30,000 per class. The spread is real, and it reflects scope rather than quality alone. A very low quoted fee usually covers data entry of an application you have already decided on; it does not cover the search that tells you whether the mark is worth filing, and it very often does not cover the examination report reply that most applications will receive.

- Drafting and e-filing of Form TM-A, and delivery of the application number and PRN

Costs that appear later
Two applications with identical filing costs can end up very far apart. Budgeting only for the filing is the mistake that leaves brands abandoned halfway.
- Examination report reply — chargeable as professional work; most first applications receive an objection under Section 9 or Section 11
- Hearing representation before the Registrar
- Opposition, if a third party files one during the four-month window after journal publication — this is contested work and is quoted case by case
- Renewal every ten years, at a government fee of ₹9,000 per class
- Restoration, if a renewal deadline is missed — a surcharge applies
A worked example
A Nagpur food manufacturer registering one brand name and its logo in class 30 as a small enterprise pays ₹4,500 in government fees per mark, per class. If the name and the logo are filed as two separate marks, that is ₹9,000 in statutory fees, plus professional fees on each. Registering the logo additionally as an artistic work under the Trademark adds a modest one-time cost and gives a second, independent cause of action against an infringer.

Is the trademark government fee refundable if my application is refused?
No. The statutory fee is paid for the examination of the application, not for its success, and it is not refunded if the mark is objected to or refused.
Do I pay again for each class?
Yes. The fee is charged per class per mark, so a single brand filed in three classes attracts three times the fee.
How much does renewal cost?
₹9,000 per class every ten years. If the deadline passes, a surcharge applies.
